I. PreambleDAMYEL specifies that its online sales are exclusively reserved for non-commercial adult individuals buying for their personal, non-professional needs, as well as for legal entities for needs other than those relating to their professional activities, who agree to fill in the mandatory fields requested at the time of registration and who have a delivery address located in one of the areas served by DAMYEL. Any acquisition made in violation of this limitation will engage the liability of the offender. DAMYEL retains the right not to deliver any order that may appear abnormal or of a nature to question the principle of an acquisition for personal needs. These general terms and conditions of sale and the special terms and conditions of sale specific to each of the items offered on the DAMYEL.com website (hereinafter "the website") solely govern the relations between the company DAMYEL (a SARL with a capital of €10,000, whose registered office is at Stains (93240), 20 rue des Huleux, registered with the Pontoise Trade and Companies Register under number 438 901 076, identified under intra-community VAT number FR 20 438 901 076) and its website customers, to the exclusion of all other terms and conditions.
II. Acceptance of General and Special Terms and Conditions of SaleAny confirmation by the customer of an order entered on the website constitutes full and complete acceptance on their part of these DAMYEL general terms and conditions of sale and the special terms and conditions of their order (ordered items as presented on the website within the limit of available quantities if mentioned, name, price, components, etc.). It is specified that prior to this confirmation, the customer has a mechanism allowing them to correct or modify their choices. This mechanism is accessible at each stage of the order entry process.
III. ProductsEach item offered on the website is subject to a brief presentation indicating its name, quantity, weight, price, composition, description, as well as storage advice.
IV. Validity Period of the OfferOur offers are only valid during the online presentation period and within the limit of available stocks. V. Username and PasswordDuring the first order, a username and a password are chosen by the customer. The username and password serve as proof of the customer's identity and bind them to any order placed through them. They have the value of an electronic signature within the meaning of the Law of March 13, 2000. The customer is solely responsible for their identifier and password and will solely bear the consequences that could result from any use by third parties who have gained knowledge of them, unless they demonstrate that the knowledge of this identifier and password is the result of a direct fault of DAMYEL. In case of a forgotten password or identifier, or in case of fear that a third party might have gained knowledge of them, the customer has a function on the website allowing them to find their identifier and choose a new password.
VI. Formation of the Contract: Operating Method and Proof6.1 Registration and Confirmation of the OrderEvery order entry is simultaneously subject to a summary before the customer is invited to confirm their order by indicating their choices regarding the delivery address and payment method. The customer is then invited to validate their order. From this operation forward, the order is automatically registered and becomes firm and final, subject to the reservation mentioned in the following paragraph. Any order with a choice of credit card payment is only considered effective when the payment centers concerned have given their approval. In the event of refusal by said centers, the order is automatically canceled without any compensation being claimable by the customer, and the customer is notified by an on-screen message from the payment center. Any order with a choice of PayPal payment is only considered effective when the payment is received by DAMYEL.
6.2 Confirmation of Receipt of the OrderDAMYEL confirms receipt of the order to the customer. This confirmation is sent to the customer via email summarizing the ordered products, the delivery address, the chosen payment method (online or by check), and indicating an order number. The information stated by the customer when taking the order binds them: in the event of an error by the customer in the wording of their contact details or those of the delivery location, notably their last name, first name, address, telephone number, email address, door code, or floor resulting in the loss of products, the customer remains responsible for paying for the lost products, and no compensation or refund can take place.
6.3 ProofThe automatic registration systems of DAMYEL's websites are considered valid proof of the nature, content, and date of (i) the customer's order, (ii) the confirmation of receipt of the order by DAMYEL, and (iii) any email exchanged between DAMYEL and the customer. Information relating to any operation carried out from the identifier will be stored and archived by DAMYEL and will serve as proof in the event of a dispute with the customer in accordance with the Law of March 13, 2000, on signatures and electronic proof. They will have probative force in the event of a dispute between the parties and will be kept by DAMYEL for an unlimited period.
VII. PriceAll prices on the website are expressed in euros. The prices indicated on the product pages do not include delivery costs. They detail the prices excluding taxes and all taxes included. Delivery costs are to be paid in addition based on the weight, volume, and destination of the order. The prices of similar products sold by DAMYEL in its stores or on its catalog may differ from the website prices without this binding DAMYEL. The customer cannot claim the acquisition of website products at store or catalog prices, and vice versa.
VIII. PaymentAt the time of entering your order, you choose to opt for payment by credit card or PayPal. In the event you choose a credit card payment, you are then redirected to the secure site of Banque Populaire, guaranteeing the preservation of the confidential nature of the card numbers through protection and cryptography procedures. Only cards bearing the CB, Visa, and Mastercard logos or the PayPal payment system are accepted. No delivery can take place without the collection of the funds through credit to the bank account for the benefit of DAMYEL as defined in Article 9 of these Terms. The invoice will thus be sent by email to the billing address. For orders exceeding €1,000, DAMYEL may require payment by bank transfer before shipping the order.
IX. Delivery9.1 GeneralThe shipment of the order can only take place after receipt of the full payment of the product prices and shipping costs. All events considered by legislation and case law as force majeure, which would tend to prevent or render exorbitant the execution of supply, constitute, by express agreement, a cause for suspension or termination of DAMYEL's obligations, without compensation to the benefit of the customer if the event extends beyond a period of fifteen (15) days. DAMYEL will inform the customer by any appropriate means of the existence of such an event in order to allow the latter to withdraw from their order by means of a simple reply by mail.
9.2 Specific Conditions for MacaronsMacarons are delivered to the recipient, from Tuesday to Friday and only in Metropolitan France and Corsica, by Chrono 13 (no delivery to Chrono Relais) or by Courier if the customer is located in the Île-de-France region, in specific packaging intended to ensure their optimal preservation. Since macarons can only be consumed until the Expiration Date ("DLC") indicated on the label under the box containing them (the DLC being five calendar days from the parcel departure date shown on the transport label), DAMYEL particularly draws its customers' attention to the necessity:i) to set a delivery date that allows the parcel to be delivered to the recipient on that date. ATTENTION: Indeed, if the parcel is collected by the recipient more than 72 hours after its departure date from DAMYEL's logistics center – the date appearing on the transport label – DAMYEL can no longer guarantee the freshness of the macarons (for example: parcel shipped on the 10th and collected by its recipient on the 14th or subsequent days);ii) to place the macarons in the refrigerator immediately upon receipt of the parcel.
9.3 Delivery CostsDelivery costs are calculated automatically during the order and appear on the page indicating the order prices before its final validation. Two delivery modes are offered:By courier in Île-de-France: €18 incl. VATBy Chronopost in France: €15 incl. VAT
9.4 Deadlines9.4.1 In Metropolitan FranceThe usual delivery times, excluding holiday periods (September back-to-school, Christmas, New Year's Day, Easter), are two business days (meaning excluding Saturday, Sunday, and public holidays) from the day following receipt of the order and payment by DAMYEL. During holidays, these deadlines are given on a strictly indicative basis.
9.4.2 Outside Metropolitan FranceDepending on the products and countries, deadlines may vary by several days or even weeks, also depending on customs clearance outside the European Union. DAMYEL invites the customer to contact the Distance Selling (VAD) Department to verify the delivery times applicable to their order.
9.4.3 Delivery DeadlineIf the ordered products have not been delivered within a maximum period of thirty (30) days following the date of receipt by DAMYEL of the order form accompanied by the payment, for any cause other than force majeure, the sale may be canceled at the customer's request by registered letter with acknowledgment of receipt. The sums paid by the customer will then be returned to them within a maximum period of fourteen (14) days following receipt of the cancellation letter by bank transfer or check. Consequently, any delivery made within thirty (30) days following receipt by DAMYEL of the order form accompanied by the payment cannot in any way justify the cancellation of the order by the customer, nor give rise to damages, compensation, or penalties. The same will apply in the event of delivery of the products before receipt by DAMYEL of the cancellation letter sent by the customer.
9.5 MethodsFor all deliveries other than those handled by the courier service (within the limits of the areas served by this method), delivery will be carried out under the so-called "Chronopost 13" mode in France and in all countries accepting this method of transport. In other countries, the shipment is made, unless expressly requested by the customer, via "Chronopost Express". For deliveries outside the European Union, the customer agrees to pay all taxes due upon the importation of products and claimed during parcel delivery, such as customs duties, value-added tax, and/or any other taxes due under the laws of the country receiving the order. DAMYEL disclaims all legal liability if the payment of taxes is not made by the customer. The customer is required to check the condition of the delivered products and to file, in the event of missing or damaged items, all reservations with the carrier by registered letter with acknowledgment of receipt within seventy-two (72) hours of delivery. In the event of non-conformity or apparent defect of the delivered products, the customer has a period of three (3) business days from receipt thereof to file a claim in writing (postal mail, email, fax) with our services, accompanied by a photograph clearly showing the damage. After this period, the delivered products will be deemed compliant and free of any apparent defects. In the event of delivery to the recipient's workplace, the customer must take all necessary precautions so that the carrier, not having access to the premises, can hand over the order to the recipient and that the latter receives it. Upon presentation of the parcel by the postal services or the carrier at the address indicated by the customer, DAMYEL has fulfilled its delivery obligation. DAMYEL thus declines all liability in the event of subsequent loss or theft.
9.6 Return CostsIn the event of a return to DAMYEL of the products ordered by the postal services or the carrier due to either i) the recipient's failure to collect the parcel within the period specified on the delivery notice left by the postal services or the carrier, or ii) the unreachability of the recipient as a result of errors or inaccuracies in the wording of their contact details and/or delivery address, or iii) the recipient's refusal of the parcel for personal convenience, all costs will be borne by the customer. For deliveries in Metropolitan France, these include: return costs to the DAMYEL warehouse as well as costs for resending the products to the recipient, which will be invoked at the same price as for delivery; for international deliveries: return costs to the DAMYEL warehouse, any customs duties as well as costs for resending the products to the recipient, which will be invoiced at the same price as for delivery in the case of a postal parcel, and, in other cases, according to the quote provided by the carrier. However, and in the event that the return costs are higher than the value of the products increased by the resending costs, the ordered products will be subject to destruction on-site, with the goods destruction costs, the cost of the new parcel, and the costs of resending the latter to the recipient being borne by the customer.
X. Warranty of Conformity of ProductsDAMYEL is bound by the legal warranty for hidden defects on the products sold. Provided that the buyer proves the hidden defect and acts within the two-year period imposed by Article 1648 of the Civil Code, the seller must legally repair all the consequences.
XI. XII. Personal InformationBy ordering via the Catalog, the customer consents to the use of personal data collected through the placement of the order. This information is essential for processing orders. DAMYEL may communicate the personal data thus collected to the service providers who contribute to the provision of its services. In accordance with the provisions of Law No. 78-17 of January 6, 1978 relating to computing, files, and freedoms, DAMYEL has declared the file to the Commission Nationale Informatique et Libertés (CNIL). At any time, you benefit from a right of access, rectification, or opposition regarding the personal data collected about you. These rights can be exercised by sending a letter to DAMYEL – Service VAD, 33 avenue Raymond Poincaré - 75016 Paris.
XIII. Protection of MinorsIt is reminded that, in accordance with the provisions of Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors is prohibited. Any person placing an order on the Catalog therefore undertakes to be at least eighteen (18) years old on the date of the order.
XIV. DisputesThese general terms and conditions as well as all operations referred to therein are subject to French law. In the event of a dispute, the customer will first address DAMYEL to find an amicable solution. Failing that, the matter will be brought before the competent French courts, it being specified that the time limits for taking legal action are not interrupted during the period of seeking an amicable solution.
XV. Returns and WithdrawalAny return accepted by Damyel, in the case of an apparent defect or non-conformity of the delivered products, which is verified by Damyel, will allow the customer to obtain a free replacement for their benefit, to the exclusion of any other indemnity or damages.
